This website noirte.in is owned and operated by Noirte ("we", "us", or "our"), a brand based in Pune, Maharashtra, India. By accessing or purchasing from noirte.in, you ("customer" or "user") agree to be bound by these Terms and Conditions.
These Terms are governed by the laws of India, including the Consumer Protection Act, 2019, the Information Technology Act, 2000, and the Consumer Protection (E-Commerce) Rules, 2020.
2. ELIGIBILITY

• You are at least 18 years of age, or accessing the site under supervision of a parent or legal guardian.
• You are legally capable of entering into binding contracts under the Indian Contract Act, 1872.
• You are not barred from receiving services under any applicable law in India.
3. PRODUCTS & PRICING

All products listed on noirte.in are physical goods. We make every effort to display accurate product descriptions, images, and pricing. However:
• Prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes (GST) unless stated otherwise.
• We reserve the right to modify prices at any time without prior notice.
• In the event of a pricing error, we reserve the right to cancel the order and issue a full refund.
• Product images are for representational purposes; actual products may vary slightly in colour or texture.
4. ORDERS & PAYMENT

When you place an order on noirte.in:
• Your order constitutes an offer to purchase the product(s) at the listed price.
• We reserve the right to accept or reject any order at our sole discretion.
• Order confirmation via email does not constitute acceptance — acceptance occurs upon dispatch.
• Payments are processed through secure third-party gateways. We do not store your financial information.
• In case of payment failure, any amount debited will be refunded within 7–10 business days.
5. CASH ON DELIVERY (COD)

Cash on Delivery is available on eligible orders and serviceable pin codes. Availability of COD is determined at checkout and is subject to change without notice. Noirte reserves the right to withdraw COD as a payment option at any time.
6. SHIPPING & DELIVERY
----------------------
We ship only within India. The following terms apply:
• Estimated delivery timelines are provided at checkout and are indicative, not guaranteed.
• Noirte is not responsible for delays caused by courier partners, natural events, or circumstances beyond our control.
• Delivery is made to the address provided at the time of order. We are not liable for non-delivery due to incorrect address details.
• Risk of loss or damage passes to the customer upon delivery to the shipping address.
• Shipping charges, if applicable, are non-refundable unless the product was incorrectly sent or is defective.
7. EXCHANGE POLICY NO CASH REFUNDS

Eligibility for Exchange
To be eligible for an exchange, the following conditions must be met:
• The item must be unused, unworn, and in its original condition.
• All original tags and packaging must be intact.
• The exchange request must be raised within 7 days of delivery.
• Items showing signs of use, washing, damage, or alteration will not be eligible for exchange.
Size Exchange
• We facilitate size exchanges subject to stock availability.
• We recommend referring to our size guide before placing an order.
• For size-related exchanges, the shipping charges for returning the item and dispatching the replacement shall be borne by the customer.
Damaged, Defective, or Incorrect Items
• In the event you receive a damaged, defective, or incorrect item, please contact us at support@noirte.in within 48 hours of delivery.
• We strongly recommend recording a clear unboxing video at the time of opening your package to facilitate quick resolution.
• Failure to notify us within 48 hours or absence of an unboxing video may affect your eligibility for an exchange in such cases.
Store Credit
• We do not offer cash refunds under any circumstances.
• If an approved exchange cannot be fulfilled due to stock unavailability, store credit equivalent to the product value will be issued.
• Store credit is non-transferable and can be used on any future purchase from noirte.in.
Exchange Process
• To initiate an exchange, contact us at support@noirte.in with your order number and photographs of the product.
• Exchanges are subject to our approval. Noirte reserves the right to reject requests that do not meet the eligibility criteria.
As per the Consumer Protection Act, 2019, nothing in this policy limits your statutory rights in case of a defective product or unfair trade practice.
8. INTELLECTUAL PROPERTY

All content on noirte.in — including logos, product images, text, designs, and branding — is the exclusive intellectual property of Noirte. Unauthorised reproduction, distribution, or commercial use is strictly prohibited and may attract legal action under applicable Indian law.
9. USER CONDUCT

You agree not to:
• Use this website for any unlawful purpose or in violation of applicable laws.
• Attempt to gain unauthorised access to any part of the website or its infrastructure.
• Post or transmit any harmful, defamatory, or offensive content.
• Use automated tools (bots, scrapers) to access or copy content from the site.
Any violation may result in immediate termination of your account and legal action under the IT Act, 2000.
10. LIMITATION OF LIABILITY

To the extent permitted under applicable Indian law, Noirte shall not be liable for:
• Indirect, incidental, or consequential damages arising from use of this website or products.
• Any loss arising from reliance on product descriptions, images, or information on the website.
• Third-party service failures, including payment gateways or courier partners.
Our maximum liability to you shall not exceed the amount paid for the product in question.

13. GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra. We encourage amicable resolution before initiating legal proceedings.
14. AMENDMENTS

Noirte reserves the right to amend these Terms at any time. Changes take effect immediately upon posting on noirte.in. Continued use of the website constitutes acceptance of the revised Terms.
